What a real 2026 court case means for anyone typing custody or divorce questions into a free AI tool
A man under federal indictment did something a lot of people would do: he opened up an AI chatbot and started typing. He walked through his case, brainstormed arguments, and prepared notes - then shared what the AI gave him with his actual lawyer. It felt private. It felt like taking notes for himself.
In February 2026, a federal judge ruled it wasn't private at all - and that those AI conversations could be used against him.

The caveat that matters more than the tool list
⚠ The case behind the warning: United States v. Heppner
In February 2026, Judge Rakoff of the U.S. District Court for the Southern District of New York ruled - in what the court called "a question of first impression nationwide" - that a criminal defendant's written exchanges with Claude, Anthropic's AI assistant, were not protected by attorney-client privilege or the work-product doctrine. The defendant had used Claude on his own, without his lawyer's direction, to think through his defense before sharing the output with counsel. The court found Claude wasn't an attorney, the chats weren't confidential, and the defendant hadn't been seeking legal advice from Claude itself.
Notably, Harvard Law Review's own analysis of the ruling argues the court's reasoning went too far - that a more fact-specific look, treating AI more like a everyday tool (similar to Gmail or Google Docs) rather than a person, would sometimes support privilege. Still, until higher courts weigh in, the safe assumption for anyone in an active legal matter is the cautious one: what you type into a free AI tool may not be protected, and may not stay private.
